• Third parties (including our affiliates and subsidiaries), including through any application or content that may link to or be accessible from or on the Website or other Mindfuli Products, as determined to have and maintain sufficient security measures.

INDIVIDUALS UNDER THE AGE OF 18

Mindfuli Services are not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on Mindfuli Platforms. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on Mindfuli Platforms or through any of its features, register on the Mindfuli Platforms, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. INFORMATION WE COLLECT ABOUT YOU & HOW WE COLLECT IT

Mindfuli Services collect several types of information from and about users of our Platforms, including information:

• By which you may be personally identified, such as name, postal address, e-mail address, telephone number, social security number, or any other identifier by which you may be contacted online or offline (“personal information“);
• That is about you but individually does not identify you, and/or
• About your internet connection, the equipment you use to access Mindfuli Platforms, and usage details.

• Directly from you when you provide it to us.
• Automatically as you navigate through the Mindfuli Platforms. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

The information we collect on or through Mindfuli Services may include:

• Information that you provide by filling in forms on our Platforms. This includes information provided at the time of registering to use our Platforms, subscribing to our service, or requesting further services. We may also ask you for information when you report a problem with our Platforms.
• Records and copies of your correspondence (including email addresses), if you contact us.
• Your responses to surveys that we might ask you to complete for research purposes.
• Your search queries on the Mindfuli Platforms.
• Your account registration process, such as whether users registered using their Facebook or Google profiles, and whether a user verifies their reported email address or phone number. 
• Your data regarding user counseling sessions such as whether a live session has been scheduled by the user, whether a Counselor or user joins a scheduled session, when a counseling session began and ended, and whether a counseling session was canceled or rescheduled.

You also may provide information to be published or displayed (hereinafter, “posted“) on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages/you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Mindfuli Platforms with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies  

As you navigate through and interact with Mindfuli Products, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

•  Details of your visits to our Products, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Products.
• Information about your computer and internet connection, including your IP address, operating system, and browser type.

The technologies we use for this automatic data collection may include:

• Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Products. • Web Beacons. Pages of our the Product and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Healthcare Data and Protected Health Information

Our platform creates records about you and the treatment and services provided, stored, and created to and by you. The information we collect is called Protected Health Information or (“PHI”). We take our obligation to keep your PHI secure and confidential very seriously. We are required by federal and state law to protect the privacy of your PHI and to provide you with this Notice about how we safeguard and use it and to notify you following a breach of your unsecured PHI. Public health activities.

• Report health information to public health authorities authorized by law to receive such information for the purpose of preventing or controlling disease, injury or disability, or monitoring immunizations.
• Report child abuse or neglect, or adult abuse, including domestic violence, to a government authority authorized by law to receive such reports.
• Report information about a product or activity that is regulated by the U.S. Food and Drug Administration (FDA) to a person responsible for the quality, safety, or effectiveness of the product or activity.
• Alert a person who may have been exposed to a communicable disease, if we are authorized by law to give this Notice.

Health oversight activities. We may disclose your PHI to:

• A government agency that is legally responsible for oversight of the health care system or for ensuring compliance with the rules of government benefit programs, such as Medicare or Medicaid.
• Other regulatory programs that need health information to determine compliance. This disclosure may include granting an agency surveyor access to your electronic health record.

Uses and disclosures of certain PHI deemed “Highly Confidential.” For certain kinds of PHI, federal and state law may require enhanced privacy protection. These would include PHI that is Maintained in psychotherapy notes, about alcohol and drug abuse prevention, treatment and referral, additional diseases and/or treatments specific defined by state law (e.g. HIV/AIDS, venereal disease, communicable disease, genetic testing, etc.).

We can only disclose this type of specially protected PHI with your prior written authorization except when specifically permitted or required by law. Any other uses and disclosures not described in this Notice will only be made with your prior written authorization.

You may cancel (“revoke”) an authorization you gave us before by terminating your use of Services. The cancellation will apply to future uses and disclosures of your PHI. It will not impact disclosures made previously, while your authorization was in effect.

You have the following rights regarding the PHI that the Service creates, obtains, and/or maintains about you.

• Right to request restrictions. You may ask us to restrict the way we use and disclose your PHI for treatment, payment, and health care operations, as explained in this Notice. If a different health care facility or professional created the information that you want to change, you should ask them to amend the information.
• Right to receive an accounting of disclosures. Upon your request, we will provide a list of the disclosures we have made of your PHI for a specific time period. However, the list will exclude:

1. Disclosures you have authorized.
2. Disclosures made earlier than six years before the date of your request (in the case of disclosures made from an electronic health record, this period may be limited to three years before the date of your request).
3. Disclosures made for treatment, payment, and health care operations purposes, except when required by law.

THIRD-PARTY USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES

Some content or applications on the Website are served by third-parties, networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
